Discipline Committee Decisions
Dr. Gobi R. Ganapathy; Dr. Vladimir Vasic; Dr. Maximous Y. M. Abdel-Malek

The College of Physicians and Surgeons of Ontario (“the College”) released the results of its most recent disciplinary hearings. The College is the licensing and disciplinary body for physicians in Ontario. Hearings are held to review allegations of professional misconduct and incompetence, and are open to the public. The following are brief summaries of recent discipline hearing results. The Discipline Committee’s full decisions and reasons for decisions are posted on the College’s website as they become available. Dr. Gobi R. Ganapathy, London. On February 13, 2009, the Discipline Committee found that Dr. Ganapathy committed an act of professional misconduct, in that he had been found guilty of an offence that is relevant to his suitability to practice medicine. Dr. Ganapathy had pleaded guilty in a criminal court to the offence of common assault contrary to the Criminal Code. The common assault was of a patient which occurred during a patient visit, an offence that is relevant to his suitability to practice. On January 6, 2010, the Committee ordered a public reprimand and Dr. Ganapathy is to pay to College’s costs fixed in the amount of $7,300.
Dr. Vladimir Vasic, (no practice address). On May 11, 2009, the Discipline Committee found that Dr. Vasic committed acts of professional misconduct, in that he sexually abused a patient; engaged in disgraceful, dishonourable or unprofessional conduct; and contravened a term, condition or limitation on his certificate of registration. Dr. Vasic made remarks of a sexual nature and engaged in sexual behaviour, including sexual intercourse, with a patient. Furthermore, Dr. Vasic practiced medicine while he knew that his certificate of registration was suspended, and failed to cooperate with the College in its investigation of this matter. On January 13, 2010, the Committee ordered a public reprimand; revocation of Dr. Vasic’s certificate of registration; and the result of the proceeding is to be included in the College’s public register. Dr. Vasic was further ordered to reimburse the College for funding provided to patients for therapy, by posting an irrevocable letter of credit in the amount of $10,000; and he is to pay the College’s costs fixed in the amount of $14,600.
Dr. Maximous Y. M. Abdel-Malek, Mississauga. On January 21, 2010, the Discipline Committee found that Dr. Abdel-Malek committed an act of professional misconduct, in that he engaged in unprofessional conduct. Between 1978 and 1994, Dr. Abdel-Malek was a general practitioner and general surgeon in Egpyt. He did a locum in Saudi Arabia between February and September 1994. In 1994, Dr. Abdel-Malek immigrated to Canada. Between his arrival in Canada in 1994 and 1998, Dr. Abdel-Malek had various occupations and engaged in various medical educational pursuits. He did not practise medicine during this time. In 2000, Dr. Abdel-Malek applied to the College for a certificate of registration, and was registered to carry on independent practice in June 2000. Dr. Abdel-Malek admits that the information he supplied to the College on his applications was not accurate, in that it overstated the duration of his practice in Egypt, failed to disclose interruptions in practice after he came to Canada in 1994, and did not disclose his period of practice in Saudi Arabia. The Committee ordered a public reprimand; he is to successfully complete, at his own expense, a medical ethics course; and the result of the proceeding is to be included in the College’s public register. Dr. Abdel-Malek was further ordered to pay the College’s costs fixed in the amount of $3,650.
